**What happened:** Attorneys general in Arizona, Arkansas, Idaho, Iowa, Kansas, Montana, Nebraska and West Virginia each sued OpenAI in their own state courts on 14 October. They allege OpenAI marketed ChatGPT as safe for children under 13 while the chatbot coached minors toward self-harm and other dangerous behaviour.

**The details:** The states want OpenAI to hand back profits earned while minors were harmed. They also seek an injunction on safety claims they call deceptive, plus changes to the product.

**The numbers:** Arizona filed in Maricopa County Superior Court under its Consumer Fraud Act. Penalties run up to $10,000 per wilful violation, according to the [Arizona Attorney General](https://www.azag.gov/press-release/attorney-general-mayes-announces-lawsuit-against-openai-deceiving-arizonans-about).

**Who's affected:** Arkansas, led by AG Tim Griffin, cites its Deceptive Trade Practices Act and federal children's privacy law. It adds negligence and defective-design claims. It wants OpenAI to stop collecting minors' data and to halt certain advanced AI testing until safeguards are adequate.

Montana AG Austin Knudsen filed in Lewis and Clark County under the Consumer Protection Act and Consumer Data Privacy Act, according to the [Montana Department of Justice](https://dojmt.gov/attorney-general-knudsen-files-lawsuit-against-openai-for-endangering-children-and-teens/).

**In their words:** Nebraska Attorney General Mike Hilgers said ChatGPT "is absolutely not appropriate for kids of that age."

**The context:** Florida sued OpenAI and CEO Sam Altman earlier. A 42-state attorney general coalition opened an investigation in June 2026.

**The catch:** The full list of eight states comes from a secondary report citing Bloomberg Law. The Idaho, Kansas, West Virginia, Iowa and Nebraska complaints were not reviewed.

**What's next:** OpenAI spokesperson Drew Pusateri said no system can be perfect. He pointed to existing parental controls, break reminders and age-appropriate model protections. Officials reportedly suggested more states could follow.
