Judge lets NAACP Clean Air Act suit against xAI proceed
The judge rejected xAI's request to dismiss, ruling its Memphis turbines are not mobile sources under state rules.
The answer
A federal judge refused to dismiss NAACP's suit alleging xAI ran unpermitted turbines near Memphis.
What happened: Federal judge Debra M. Brown has denied xAI's request to dismiss a Clean Air Act lawsuit brought by the NAACP, so the case will proceed. TechCrunch reported the ruling on 31 October.
The numbers: The NAACP, represented by the Southern Environmental Law Center, says xAI ran gas turbines at its Colossus data centre outside Memphis without the required preconstruction or operating air permits. Plaintiffs say xAI installed and operated at least 35 combustion turbines and other sources of air pollution at the site.
The catch: xAI argued three things: the turbines are mobile and therefore exempt from permitting, the plaintiffs lack standing, and citizen suits like this one are unconstitutional. Brown rejected all three. She found the plaintiffs have statutory standing and that the turbines are not mobile sources under Mississippi's State Implementation Plan.
In their words: Abre' Connor, director of environmental and climate justice at the NAACP, said: "Our position has been clear: xAI cannot operate gas turbines without the required permits."
Why it matters: The ruling removes xAI's three arguments at this stage, leaving the permit question for the courts. Brown also held that the citizen-suit provision does not violate the Constitution, reasoning that such plaintiffs sue in their own name and seek penalties for harm to themselves.
The context: TechCrunch cites growing opposition to data centres. New York has passed a moratorium on new data centres, and Amazon and Microsoft have pledged to stop using NDAs with government agencies. A similar Justice Department motion to dismiss was also denied earlier in October.
What's next: The case now moves into litigation, and the report gives no timeline. TechCrunch reached out to SpaceX for comment, and no response is reported.
