Judge strikes down Pentagon's "supply chain risk" label on Anthropic

What happened: US District Judge Rita Lin ruled on 27 August 2026 that the Pentagon's "supply chain risk" designation of Anthropic was unlawful and ordered it removed.

The details: Lin found Defense Secretary Pete Hegseth's label violated the First Amendment as retaliation against a government critic, was "arbitrary and capricious," and denied Anthropic due process under the Fifth Amendment. She called the national-security evidence "slim."

The context: Anthropic had refused to let the Pentagon use its models for fully autonomous weapons or mass surveillance of Americans. Hegseth then posted that no military contractor, supplier or partner could do business with the company.

The catch: The "supply chain risk" label had almost always been reserved for firms tied to foreign adversaries. This was its first use against a US company over a policy dispute.

Why it matters: The ruling curbs government attempts to punish AI firms for refusing military uses of their technology on safety grounds.

In their words: "The empty invocation of national security is not a blank check to punish and retaliate against government critics," Lin wrote.

Who's affected: Anthropic, which sued in March 2026 after Lin had already granted a preliminary injunction that month. An Anthropic spokesperson said: "We welcome the court's ruling that this supply chain risk designation was unlawful."

What's next: The government can appeal. A second, related Anthropic lawsuit is still pending in Washington, DC.
